DOMA: Bringing Back Minority Discrimination
The Defense of Marriage Act, normally known as DOMA, is a United States national official organization law that defines the term marriage as only a legal union between adept man and one woman as husband and wife. The law prevents married couples of the same-sex from obtaining the federal benefits given to married couples of the opposite sex and excuses states from recognizing same-sex marriages legalized in different states. The DOMA law is a bad law because the means of its creation violates amendment rights, promotes minority discrimination, and contradicts the federal governments promise of adapted protection downstairs the law.
In 1996 Congress enacted the DOMA law in response to the howdy Supreme Court ruling of 1993 in Baehr v. Lewin that same-sex couples might be entitled to marry in the state. This ruling, however, initiated commotion of horror from religious and social conservatives who believed it to be an attack on what they refer to as traditional marriage or diachronic marriage, that is marriage reserved as a special countenance for opposite-sex couples (Robinson).



The feelings of these conservative Hawaiians reached out to federal officials whose main concern was that Hawaiis redefinition of marriage to include homosexuals would enable them to qualify for federal rights and benefits (Robinson). Throughout the 1990s states initiated lawsuits to recognize same-sex marriages such as Hawaii, Vermont, Alaska, and separate states. As for the other opposing states, they triggered the DOMAs to suppress same-sex marriages and prevent early outbreaks. Then, in 1996 DOMA was passed as a federal law.
The basis on which the DOMA law was passed is unconstitutional due to the fact that it denies homosexuals equal rights under the law, such as marriage benefits.
